European Court of Justice Rules Against Diesel in Transit Case
IPKAT has a good blurb on the November 8 decision of the European Court of Justice in Montex Holdings Ltd v Diesel SpA. The case involved an attempt by Diesel, which has trademark protection in Germany, to stop the transport through Germany of fake Diesel jeans en route to Ireland, where Diesel has no trademark protection. The court held that Diesel could not interfere with the transit of the jeans under these circumstances.
